Former CNN anchor, Don Lemon, was arrested and charged last night with federal offenses following his entry into a Minnesota church during an ongoing religious service, an action critics say violated laws protecting worshippers and constituted criminal trespass and interference.

 

The incident in question took place on January 18, 2026, at Cities Church in St. Paul, Minnesota. A group of anti-immigration enforcement (anti-ICE) rioters entered the private property mid-service, reportedly because one of the church’s pastors works as an ICE official.

 

Lemon, who has stated he was there to document the event for his YouTube channel, entered the building alongside the protesters, recorded video, and approached attendees despite repeated requests to leave.

 

Amidst the furry of opinions and emotional hype, here are five clear points concerning Lemon’s arrest:

 

1. No First Amendment Right to Disrupt Worship

 

There is no constitutional protection under the First Amendment, for either protest or press coverage, that allows someone to enter a house of worship and interrupt an ongoing religious service.

 

Journalists and protesters alike have no legal entitlement to be inside a private church during services without explicit permission. Lemon did not have permission.

 

2. Federal Law Protects Religious Services

 

The incident is alleged to violate the Freedom of Access to Clinic Entrances (FACE) Act, a federal statute that criminalizes using force, threats, or physical obstruction to interfere with individuals’ access to religious services or to intentionally disrupt worship in a house of worship.

 

Approaching parishioners with microphones and recording equipment during the service has been cited as clear interference, with no exemption granted for claimed journalistic purposes.

 

3. Trespass on Private Property During a Service

 

When a group of anti-ICE protesters entered mid-service, Don Lemon, documenting for his YouTube channel, entered the private property, recorded, and engaged with attendees despite requests to leave.

 

Standard journalistic practice requires remaining on public areas (such as sidewalks) when covering private property without prior authorization; entering without permission constitutes trespass, made more serious by occurring during an active religious service.

 

4. Congregants Reported Fear and Harm

 

Church attendees described feeling scared and hurt by the intrusion. Video footage reportedly shows Lemon acknowledging the distress caused to those present, undermining claims that the entry was benign or purely observational.

 

5. Prosecution Proceeds Via Grand Jury Indictment

 

After a magistrate judge declined to approve certain charges through a criminal complaint, Chief U.S. District Court Judge Patrick J. Schiltz ruled that prosecutors could instead present the case to a grand jury.

 

The Department of Justice did so, and on January 29, 2026, a grand jury found probable cause, issuing an indictment against Lemon and others on multiple federal counts related to interference with religious exercise. Lemon now faces criminal prosecution as well as likely civil lawsuits from affected congregants, potentially resulting in significant financial liability.

 

Lemon has denied affiliation with the protesters and maintains his actions constituted protected news gathering. Despite the case still unfolding, what we know to be true is this: if you break the law, you will face consequences. Period.
