Victory for Free Speech and A Women’s Right to Truth

On Monday, December 1, 2025, the U.S. Court of Appeals for the Second Circuit handed down a significant win for free speech and for women who deserve full, honest information at one of the most vulnerable moments of their lives.
In a unanimous ruling, the court upheld a lower court’s injunction that stops New York Attorney General Letitia James from silencing pro-life pregnancy centers while their lawsuit against her proceeds. Thankfully, the centers are represented by my good friends over at Alliance Defending Freedom.
Back in 2024, James sued the centers for the horrific “crime” of telling women that there is a possibility of reversing a chemical abortion after taking the first pill (mifepristone) by promptly receiving supplemental progesterone.
Yes, you read that correctly: the state of New York tried to make it illegal for nonprofit, faith-based centers to share peer-reviewed medical information about a safe, evidence-based protocol that has already helped thousands of women save their babies when they changed their minds. Isn’t this exactly what the so-called “choice” crowd would want? More choices?
Much to my surprise and delight, the appeals court saw through the censorship attempt.
In clear language, the three-judge panel reaffirmed that the pregnancy centers’ speech is non-commercial which simply means that they receive no financial benefit and do not administer the protocol themselves) and is driven by deeply held religious and moral convictions, exactly the kind of speech the First Amendment was written to protect!
One of my favorite excerpts from the opinion:
“The district court correctly determined that the speech at issue is noncommercial because… the speech is religiously and morally motivated, the NIFLA plaintiffs receive no remuneration or other financial benefit for engaging in it, and… the speech serves only to provide the public with information about APR and access to third-party providers that can offer APR.”
Despite their best attempts to label the abortion pill reversal protocol as “fringe,” the left has failed. Instead, this brilliant creation of modern science has stood on its own as a modern miracle!
Biologically, we know that progesterone is a hormone that occurs naturally in the female body throughout pregnancy. Progesterone is also the key to the success of the reversal protocol, and doctors have utilized it for decades to prevent miscarriage and preterm birth.
When administered quickly after mifepristone (usually within 24–72 hours), studies show a 64–68% success rate in continuing the pregnancy, rates comparable to or better than many commonly accepted miscarriage prevention protocols.
As of today, the abortion-pill reversal network reports more than 7,000 documented cases of babies saved when mothers chose reversal after starting a chemical abortion! Thank God!
Rather than celebrate more options for vulnerable women that would actually empower them, rather than be stuck with regret, Attorney General James launched a legal crusade to force these centers to stay silent, labeling their speech “false and misleading” despite substantial medical literature to the contrary.
This week’s ruling is only a preliminary injunction; however, the underlying case will continue, but it is a powerful affirmation that government officials don’t get to play speech police simply because they disagree with the message.
Women facing an unexpected pregnancy deserve to hear every option, not just the ones approved by the state.
The marketplace of ideas and the marketplace of life-affirming choices must remain open, especially when a child’s life hangs in the balance.
I’m so grateful courts still exist that recognize the Constitution.
