DOJ to Protect Parental Rights & Free Speech in Schools After Biden-Era Suppression

The Department of Justice issued a memo directing the Civil Rights Division to collaborate with federal, state, and local partners to protect parental rights and free speech in education, following years of suppression under the Biden administration.
Attorney General Pam Bondi criticized state and local authorities for imposing radical gender and racial ideologies in schools while silencing dissenting parents. She emphasized that First Amendment rights, including free speech and petitioning at school board meetings, must be upheld, and that parents should be able to exempt their children from instruction conflicting with their religious beliefs.

Under the Biden administration, parental rights were repeatedly violated, with some parents arrested at school board meetings.
A notable case in Loudoun County, Virginia, involved a transgender student allegedly assaulting two female students in 2021, leading to the arrest of a victim’s parent for protesting at a school board meeting. Former Superintendent Scott Ziegler was convicted in 2023 for retaliating against a teacher who exposed the district’s cover-up of the assaults.

In 2023, Montgomery County Public Schools in Maryland barred parents from opting their children out of gender identity lessons. In 2021, the National School Boards Association labeled dissenting parents as “domestic terrorists” in a letter to President Biden, prompting then-Attorney General Merrick Garland to direct federal law enforcement to address threats against school officials. Documents later revealed through FOIA requests showed Biden’s administration considered using the Patriot Act against parents, as noted by Rep. Jim Jordan.
