McKenna West faced an impossible choice: comply with the biological parents’ demand to abort the baby she was carrying, or refuse and face the legal and financial consequences. She chose life, fled to Texas, and baby Gabriel was born Wednesday, August 13, 2026.

 

In April 2026, West learned the baby she was carrying had hypoplastic left heart syndrome, a serious heart defect diagnosed at 20 weeks. The biological parents demanded she terminate the pregnancy. West refused. She knew what was at stake: not just a contract, but a human life.

 

With the support of Texas Attorney General Ken Paxton, West escaped to Texas, where state law protected both her and the baby. Gabriel arrived safely and immediately received urgent medical care from UT Southwestern Medical Center and Children’s Medical Center of Dallas. Paxton personally ensured the medical institutions fulfilled their legal obligations under Texas law to provide lifesaving care.

 

“Baby Gabriel deserves a chance at life, and I will not allow anyone to unlawfully deny him medically necessary care,” Paxton said in a statement. “My office will use every tool available to protect innocent lives and ensure that every child receives the care required under Texas law.”

 

The Attorney General’s office is committed to providing both West and Gabriel every legal and medical protection Texas can offer, even as a legal battle continues over custody of the child.

 

Gabriel’s story is not unique. In July 2026, another surrogate mother was sued after refusing to abort her baby when doctors discovered a cleft lip and possible heart defect. A pattern is emerging: biological parents view surrogacy contracts as absolute, with no room for the surrogate’s conscience or the child’s right to life.

 

This reveals a fundamental question society must answer: Can a contract override a human being’s moral convictions? Can financial obligations compel participation in ending a life? The law in Texas says no. In other states, the answer remains unclear.

 

McKenna West stood at a crossroads and chose faithfulness over fear. She chose life over contract. She chose to honor the sanctity of the child growing inside her, even at great personal cost. Gabriel lives because one woman refused to comply with death.

 

Texas protected that choice. Other states must do the same. Every surrogate mother, every unborn child, deserves the same protection West and Gabriel received.
