Stripping the deep state of their tools of surveillance wasn’t on our 2025 bingo card, but here we are.

Yesterday, Representative Anna Paulina Luna introduced the “American Privacy Restoration Act,” a bill aimed at fully repealing the USA PATRIOT Act which came into play a month after the 9/11 terrorist attack.

The sweeping law, long criticized for its expansive government surveillance powers, is now in the crosshairs of Luna’s legislation, which seeks to dismantle what she calls a tool of “deep state overreach” and restore constitutional protections for Americans.

The Act granted federal agencies unprecedented authority to collect personal data, conduct warrantless surveillance, and detain individuals with minimal judicial oversight.

Whilst initially justified as a necessary measure to combat terrorism, the law has faced growing scrutiny for enabling abuses of power.

“For over two decades, rogue actors within our U.S. intelligence agencies have used the Patriot Act to create the most sophisticated, unaccountable surveillance apparatus in the Western world,” Luna declared in a statement to Breitbart News.

“My legislation will strip the deep state of these tools and protect every American’s Fourth Amendment right against unreasonable searches and seizures. It’s past time to rein in our intelligence agencies and restore the right to privacy.”

Whistleblower reports have repeatedly exposed rampant misuse, including the spying on innocent Americans, interference in elections, and the use of National Security Letters to access private data without court approval.

Intelligence agency officials have long used the PATRIOT Act as their excuse to bypass the Fourth Amendment, utilizing surveillance tools to settle personal scores and spy on untold numbers of innocent Americans. We’ll give you just one of many examples.

Despite initial promises to limit such practices, the Obama administration continued the National Security Agency’s (NSA) bulk collection of telephone metadata, and in 2013, the NSA was exposed for collecting phone records of virtually all Americans without warrants under the PATRIOT Act.

The Obama administration defended this collection as a necessary tool for national security, though it faced legal challenges and public backlash .

The “American Privacy Restoration Act” builds on earlier efforts to curb government overreach, drawing inspiration from the Fourth Amendment Restoration Act introduced in the 117th Congress which sought to require judicial warrants for domestic surveillance and repeal provisions of the Foreign Intelligence Surveillance Act (FISA).

Luna’s proposal goes further, aiming to eliminate the Patriot Act entirely and prohibit intelligence agencies from continuing surveillance through alternative legal channels.

The bill faces an uphill battle, however, with national security hawks and establishment figures expected to push back as many have done so in the past, arguing the surveillance tools remain essential to counter modern threats.

Privacy-oriented lawmakers, including House Judiciary Committee Chairman Jim Jordan, have signaled support for reforms to protect Americans’ constitutional rights including a 2024 amendment that would have required warrants for searches of Americans’ communications under FISA.

Luna’s bill represents a defining moment in the fight against government overreach and the restoration of the entirety of the U.S. Constitution.

The future of the bill remains uncertain, but one thing is clear: Representative Anna Paulina Luna has ignited a firestorm of support for dismantling the Patriot Act and restoring the right to privacy.
